My neighbour and I are trying to complain about Elm tree which is on the pavement outside her property. The Elm tree has had the base of the trunk almost totally covered with tarmac by the council which means there is little ground exposed for water to reach the base of the tree. She has lived in her house for 17 years and since last summer, we have both experienced the growth of suckers in our front gardens. In her garden there are at leats 13 new elm trees groing in between her crazy paving and some of them are nearly 5 ft high. ( her garden consists of roses in small beds intertwined with crazy paving and the suckers are growing up through the rose beds but are now starting to lift the paving) My garden is different as I have 4 beds in each corner with shrubs and then the main area is gravelled over. My suckers are smaller than hers but I am further away from the tree. I have taken up some of the gravel and the tree roots are clearly exposed going under the flags in front of my front lounge window. Our houses are on (we think... concrete base built around 1920). The soil in our area is sandy as we are near to the coast. I would like to remove all the roots from my front garden as I feel unhappy about them growing under the house. The council say that I am allowed to take them out up to my boundary but if as a result of doing that there is damage to the tree then I am liable. This does not seem fair as I want to take reasonable precautions as a home owner to protect my property. I have been unable to ascertain the reason why the tarmac was placed at the base of the tree when this was previously grassed. My neighbour has damage to her garden and she wants the council to pay to rectify this and either remove the tree or pay for a root barrier so that we are not troulbed further with the roots. We have bben informed that the tree is healthy although we feel that photos taken last year clearly shows a more dense growth than now. There is now evidence that the sucker growth is starting in the paving flags on the pavement around the tree. The tree has peeling bark and some dots of fungus on lower branches. Can you give me any advice at all please?
