Good afternoon

Under Section 159 Paragraph 1, 2 and 3 of the Water Industry Act 1991, it would appear that a statutory undertaker can access their infrastructure to carry out maintenance, remove obstructions like trees if necessary and ask for costs of removing the obstruction to be paid by the pipe owner - who can refuse.

Schedule 12 then says that compensation should be paid for any loss or damage during the works.

Can London Councils demand compensation for their street trees, based on CAVAT, if they have to be removed to carry out essential maintenance or are statutory undertakers exempt from paying this?
