Japanese Weeping Cherry Tree Pruning

I have a japanese weeping cherry tree that is in need of a good pruning. Since it was planted last year, it has begun to look like a crab. New branches are growing upwards and some of the older branches are not angling to the ground anymore.

What branches should be removed and is it OK to tie down the older branches so they point to the ground again?? Also, is fall a good time to prune the tree? I live in central New Jersey.
