small oak tree

I have a small (7') oak that's sprouted up in my courtyard close to the old cottage I live in (over 135 years old). If I cut it down will I need to remove the roots or can I just SBK the stump?
Also is it this that's caused my clematis almondii to fail recently? they share the same area.
p.s. I won't mention the neighbour who is 'worried' about the roots
