Maple lost leaves in early August

We have a Maple tree that lost all of it's leaves in early August this year. We had a very dry and hot period over the summer. The tree sprouted a few small green leaves unevenly around the tree. There are no buds formed and the branches seem kind of brittle. Could this type of tree be dormant? This tree is on a hillside and there are a lot of surface roots. Around 3 years ago I did cut some of the roots to install some edging to contain the roots. There is a retaining wall about 6 feet uphill from the tree. Our subdivision has started the project to remove the wood tie wall system and install concrete block walls in their place. I am trying to decide if I should go ahead and remove the tree and let them grade the area withe the rest of the yard. If I wait until spring and the tree does not make it I will have to deal with the tree and stump removal and planting grass there. Please let me know your opinion. Thanks.
