Eucalyptus Trees

I wondered if you could advise me on an unusual problem.
My parents had a 12 year old Eucalyptus tree in their back garden. Recent high winds have blown it over and with it it took 5 new fence panels and a concrete post belonging to a neighbour.
My parents insurance company refuse to pay for the damage, saying that the tree (which was about 50ft high) is classed as a plant.
Do you know if they are regarded as 'trees' or 'plants'?
We would apreciate your advice on this.
