TPO Case Law

Hi
Quick question, i am looking for case law relating to a TPO appeal statement i am writing. The tree i am looking at is a Large beech near a wall and is causing damage, the owners are appealing against a refusal of consent to fell the tree from the local council.
i need any case law that will relate to this in relation directly to or on the smae lines of the problem.
