First let me say hi, as a new subscriber to this forum. I am a local
authority officer working in essex, and have been doing this job for quite a
few years.

Second a plea, I have already posted this on the ask an arborist site and
had
a quick reply re: the sun timber case. But my question is this.

A owns tpo'd tree, it overhangs B's garden, b cuts back without LA
permission
or neighbours. I know about the hole issue when tree is not protected, but
we
are considering a prossicution, and our legal department seem split. Does
anyone have any info or case law that will help us decide. Thanks for your
help, I look forward to joining in the forum and helping where I can.
