The law on leaves is based on judicial law and as you quote, "once they
have left the tree, are subject to the will of God". I cannot quote the
precedent law but, I believe it may be covered in the AAIS Trees in
Focus publication. I'm sorry to say, but I personally find people that
have a problem with leaves, a bit hard to bare. It is a fact of life, part
of the gardening year and a price well worth paying for to enjoy the
beauty, luxury and enjoyment of trees. Only thing is, there is a liability
to clear them from paths and roads as they cause a slip hazard (where
appropriate) but, the owner of the land has that duty of care.

Hi UKTC, I am looking for a point of reference with regard to the law on
fallen leaves. I have heard it said that leaves are no longer the owners
responsibility on leaving the tree from which they grew. Is this a true fact
or a well used excuse for avoiding leaf clearance obligations on adjacent
land ? Has the adjacent owner any rights concerning return of the leaves to
their owner.
I am clear on the position with respect to fruit and overhanging branches,
but have not been able to find any case law on leaves as yet.
