The definition is taken from a civil legal judgement
as explained in the document itself. The document goes
on to say, "because of the circumstances of the case,
it does not constitute a legal precedent, but might be
used for future legislation, along with further
refinements." I see this whole issue strewn with
minefields. The government document seems to suggest
that future cases do not represent any great concern,
it is the on-going disputes that are the problem.
