I am sure you will have received Paul Hawkesford's information on
availability of the CTLA System, i.e. from ISA Europe.
The present version is the 9th edition and has been re-worked well. It is a
very comprehensive system that requires that you account for everything
about the
tree(s) lost or damaged, i.e. you are asked to assess
Condition,
Landscape value,
Species Rating.
Location Rating,
Contribution etc.
Depending upon the size and location etc of the tree(s) you have essentially
3 systems to choose from
1. Trunk Formulae Method
2. Nearest Replacement Method
3. Rela Estate Value Method
I have personally used the first two with some success. One area where it
scores over Helliwell is that it allows the valuation of landscape plants
such as shrubs, hedges etc., currently not covered by Helliwell.
The major flaw with Helliwell as I see it, is that it allows you to derive a
ZERO value for a tree. This is because if focuses on 'Visual Amenity'
only - so technically, if you can't see the tree it has no value. Within
Helliwell it is possible to assign a '0' value to some factors, notably
Amenity, both Public and Private and to size if memory serves. Now
mathematically, in any equation you are solving, if any product is
multiplied by zero then the whole equation solves to zero. I would simply
ask that you consider the benefits of Urban Trees, over and above 'Visual
Amenity', i.e. look to Amenity in the broader context, and then consider the
Helliwell Approach. I argued this successsfully in an appeal, where I
stated that it was not appropriate to say because you can't see the tree,
there is no value attached to it. The Inspector agreed with me.
I would also recommend that you look closely at Helliwell's definition of
'Special Factors'. He excludes a TPO, but includes a Conservation Area with
the proviso that it was created to protect trees. Well I fail to see the
difference. A CA is not primarily designed to protect trees, it protects an
area of Architectural / Historic merit and all features that contribute -
this is where trees come in. By contrast, a TPO is a legal instrument,
created under an Act of Parliament to protect trees. I would also draw your
attention to the fact that the part of the 1990 Act which gives the power to
create TPOs and to take action against violation is entitled,
"Section VIII - Special Controls - Trees" Parliament in its wisdom has
decided that trees, protected by TPOs are 'Special'. What then is the logic
of Helliwell's argument?
The main advantages of the CTLA Methods 1 & 2, is that once you have worked
out what it calls an 'Appraised Value' you then calculate how long it will
take for the replacement(s) to fill the void occupied by the tree(s) lost.
One then takes the Appraised Value and projects that figure over the time at
an appropriate rate of interest, usually around 8% in UK Courts. In one
instance I calculated a Helliwell value of some £12,000 but the CTLA (2)
produced £36,000, which allowed for mitigation.
The beauty of both methods is that they allow for mitigation, i.e. you
subtract the value of what you are putting back in your calculation of
Appraised Value. Courts tend to like systems that produce a value based on
a sound appraisal, allow for mitigation and include the element of time is a
logical, mathematically sound equation. Of course I cannot second guess
what a Court would do, but my experience and instincts tell me this is an
intrinsically better system.
I would reommend that you get a copy of the CTLA System and try it out for
yourself.

Could you ellaborate and perhaps let me know how to get hold of any
literature
available on this subject.
We currently use the Helliwell system and would be very interested to find

know I am using the CTLA Method in an up coming court case - I'll let
you
know how it turns out.
Its far better than Helliwell as it values much more than just visual
amenity and there are three, possibly four different approaches
described
with worked examples.
