Couple of points to ponder.

Works to abate a nuisance are exempt - fair enough. But, if squirrels are
getting into a roof and causing damage, is it the tree that's the nuisance
and therefore is pruning exempt? 

And would pruning stop them getting in. No, as they can climb walls and
drainpipes etc- so pruning would not abate the nuisance. If the pruning
doesn't abate the nuisance - would it still be exempt?

I see a fat lawyers fee in the offing
