Noddy You have it right in one. On the basis of this attempted prosecution, HSE seem to be adopting a strategy of picking on the small guys with no real justification in the hope of getting a high profile result. Certainly their arguments in this case were pathetically inadequate and should be of concern to all contractors in the event of an accident. From my experience in this case, I am very doubtful about whether they know what a worksite looks like, let alone how one should be run or what industry best practise actually is. These are indeed worrying times for anyone in contracting. Jeremy |
