Neil,

I am not clear what you are saying but hope the following may be of use.

I am aware of a case involving the ombudsman when an LPA where criticised
for determining too promptly because in essence the LPA had denied the
locals the opportunity to comment on what was proposed - remember this is a
consultation period is it not??

Can anyone advise?

Currently we run a system where applications for tree work weather in a
Conservation area or Protected by a TPO; if they are not in the public
interest to advertise them (this down to delegated powers)
We will issue a decision notice after the before the 6 weeks or 8 weeks
which ever.

My question is can we issue a decision before time?
Our planning department wants to cut down on paper work hanging around in
the office????
