Am I right in saying with tpo's the LA do not have to publicise
applications? I get this impression from reading 6.43 of the blue book. At
the moment we put up a site notice and send letters to residents, and then
wait three weeks until we determine a decision. This is all very well and
gives us brownie points with the ombudsman, but sometimes I feel it is so
unnecessary and can take up a lot of time that could be put to better use
else where.

I'm going to gree with John and disagree with Jerry.
With a CA 211 notification the Ombudsman in the 1990 complaint 88/A/2251
against Thanet District Council concluded that:
"...the six week period...is at least partly intended to give the public an
opportunity to make representations, and therefore a local authority which
grants express consent after three weeks (the time in this case but
effectively before 6 weeks is up) is guilty of maladministration, because it
has reduced the opportunity for making such representations"
Anal I know, but this is the stuff of which our proper procedures are based
on and we MUST adhere to them.
