Can a TPO be retrospectively revoked? The situation is one of a TPO
consisting of a single tree which had outgrown it's location & was causing
increasing structural damage (the issue as to whether the Order should have
been served in the first place is another question). Verbal agreement was
made with the owner that the tree should go and that he could apply / or we
would revoke. Revocation was decided upon. However, the owner's jumped the
gun and had the tree removed prior to formal revocation. We want to revoke
because the Order could be considered to be dodgy in the first place & site
conditions preclude replacement.
