Morning Keith, no doubt you have the so called blue book, an indispensible
item in these matters: "Tree Preservation Orders: A Guide to the Law and
Good Practice" ISBN 1 85112 361X £8 when I bought it. Chestnuts do this,
don't they, its part of their charm, and the retrenchment which you follow
with your saw if you have to reduces the risk of windthrow. Still, you doubt
the wisdom of the decision, why not test it at appeal...

Last week, I pruned a couple of trees (a sweet chestnut, and a sycamore).
The customer would have preferred to have them taken out altogether, but the
application was declined. The sycamore is a fairly typical sycamore, but
there's no particular reason to take it out so I understand that, but the
chestnut is dying back variously about itself, and has a large wound at the
base, healed, but showing clear evidence of rot within. Also, before
pruning, they were beginning to encroach on one another. I'd have thought it
would be perfectly reasonable to take it out, but as I said, the application
was declined, and no reason given. The tree seems stable enough, but if it
did fall, it could land on the local electricity sub station, the road, or
the garage.
Can anyone advise on the right of appeal against TPO decisions, or any other
helpful tips.
