You are lucky then.  Try that on a piece of infill development where the 
developer needs to get as many houses on site as possible to make it 
economically viable.  My experience is that the mature trees will be felled 
and some poxy little replacements put on the landscaping plans.

It is also my experience that most of the developers in this area, where the 
houses sell for several millions, dont give a rats arse about the trees.  In 
the ever increasing scenario where the TPO dept manages to place the site 
under a TPO then, and only then, is it time for negotiation.

Am I being too hard on the poor developers?

Hi,
There is clearly room for give and take but at least when a developer is 
considering buying some land he is aware of the likely restrictions. We have 
done this on one site when the Chief Planning Officer was keen.The site was 
ringed by mature trees on an old college site. Taking account of the size of 
the trees I drew a line round the site indicating the no build zone. The 
developer never made any serious complaint.

I can't see this working- for example what is the potential height of a
tree? And who would treat a tree to the north as identical to a tree to the
south, in respect to light/nuisance etc? It would be nice to know a little
about those failed challenges, does the Taunton Deane TO lurk out there?

I can think of a few new developments in Taunton Deane well within falling
distance of Sequiadendron giganteum in the town of Wellington.

Hi,
We are thinking of including on our supplementary planning guidance the
advice that there should be no dwellings within 2/3rds the potential height
of a protected tree. We are taking the lead from Taunton Dean DC which
introduced it a few years ago. They say it has worked well. The odd
developer has challenged it, but unsuccessfully. As any Arb. Officer will
know this is not about protecting roots but preventing complaints about the
tree afterwards. It does seem a shame that the people who should be enjoying
the tree most,rarely do.
Any comments please.
