I would draw your attention to the wonderfully clear section 66 (3): "(3) In this section "evergreen" means an evergreen tree or shrub or a semi-evergreen tree or shrub." Now if I was being really bloody-minded (what, me?) I'd argue that semi means half, ever means always and green means green, so semi-evergreen means green half the time.
