Strictly speaking if the tree was not marked for removal on the planning
application then it should go back to the planning dept as a variation. In
reality leaving a tree on the edge of an excavation with half it's roots gone
is not a good idea. I would suggest that the TPZ was not extensive enough in
the first place [if there was one considerd at all by the applicant/planners]
Sometimes you just have to say Ok [adding a 'told-you-so' clause if you can!]
and try and screw them down hard on the replanting/landscaping conditions.

Hello all,
I would welcome the thoughts of the forum on the following scenario. A
development is granted planning permission within a Conservation area which
requires the removal of some adjacent trees but not all.
During the early construction period it is discovered that 1 other tree needs
to be removed because larger excavations for a retaining wall need to be
carried out.
Is the tree considered to be exempt from the protection of a Conservation
area as permission has been granted for the development and the tree is
required to be removed for the purpose of carrying out the development?
Any comments appreciated.
