There is a very old precedent in a PLI where the notorious Hubert
Dorrington
Batchelor drove a bulldozer through a woodland whilst trying to avoid
the
service of a TPO notification on him.
I cant remember the name of the woods which were on the back of the
downs
in the Alkham Valley bordering Folkestone and Dover.
He claimed that what remained of the trees, when the serving officers
caught
up with him i.e. mangled stumps were not worthy of preservation. The
Inspector
(I was the Technical Assessor) agreed with me that the remains were
those of
a poor coppicing operation and that the trees would regrow. He further
agreed that the stools had a future visual amenity benefit albeit that
at some
stage that might temporarily be reduced by genuine coppicing
operations. It
would then of course again have a future benefit and so on.
The Order was therefore confirmed. Another Order for this was in the
days
when there was a right of objection to the Secretary of State against
confirmation of an Order, also in the Kent area was also confirmed on
coppiced
woodland.
Perhaps someone can help me with the name of the woodlands
............aaaah memory must be a wonderful thing.
