I accept that there may be many reasons from a public point of view not to
charge but the Planning & Compulsory Purchase Act 2004 (section 53) gives
the LPA the power to charge (still not sure if this has come into force
yet?).
Lloyd, we are aware that there are problems but if we can charge and get
direct resources into the tree function then the service will inevitably
improve....I hope?
Dom, if the applicant has not paid the fee then the application is invalid,
that is not non determination and should be include under the act?

What happens when someone submits a valid application and refuses to pay -
could they appeal against non-determination or go to the ombudsman? I
suspect you'd have a weak case but you might need to run this past your
lawyers.
