If you have a structured, if not quantitative, method available for
assessing the suitability of a tree for a TPO, then that will pretty
much cover you providing the tree you have chosen not to TPO falls the
"right" side of the line that is.
When I was in private practice I complained about a local authority to
the Ombudsman on the grounds that it was failing in its statutory duty
to protect an important amenity tree. The ombudsman's view in that case
was that whether to make a TPO or not was a matter of professional
opinion and that there had been no procedural irregularities.

I would be interested to learn of any LPAs who have a procedure for
considering objections to decisions NOT to make TPOs.
