Recently the police have actually arrested several people here and recovered
the costs of the tree but they were drunk and caught in the act.
The case I am referring to now is actually a pretty prominent row of hawthorn
say 15m long, in my opinion it is so called 'adults' doing the vandalism here
so wont be a one off, therefore replacement is not advisable. There is also
the fact they will regenerate.
It is my understanding that with sufficient evidence it would be possible to
present a case for criminal damage of council property, this would mean
putting a value on a tree or group of trees using Helliwell or something
similar with a view to demonstrating a reduction in monetary value which
would be the amount payable to the council.
I think I am going to do as suggested by Paul H, at least then we are at
least doing something!!

We never pursue it because we could never gain sufficient independent
eyewitness evidence, especially now we have PACE, where confessions have to
be gained under tight criteria. then you have to consider what would be the
likely outcome of a prosecution for damage to a Council owned (non protected
tree?). The police actually caught a drunken youth in the act of vandalising
a newly planted tree one weekend here at Mole Valley, and they asked us how
we wished to deal with it ... the upshot was, that we agreed with the police
that the culprit should pay the cost of replanting to the Council ... about
£75. I don't know if he ever did this. Put it down to experience and think
about whether you want another tree in that position or whether the residents
even deserve one at all!

Hello all
I wanted to know how other councils deal with cases of the above? I
have a couple of cases every year when someone decides to cut down
some
trees on council land for whatever reason but always find myself
feeling
powerless to do anything without having any witnesses happy to come
forward.
It is usually pretty obvious that it is 'someone' adjacent to the
trees
but quite often not possible to pin it on the right person. I have
written to people in these areas in the past with a standard 'we are
aware that someone is being a naughty monkey' letter without directly
pointing the finger at anyone but feel this may be unfair on anyone
other than the culprit.
So, do any of you get the Police involved to do some door knocking
enquiries? Or the above, or let it go as something we can do very
little about. Or does anyone carry any legal powers similar to those
with TPO's etc?
