Ron,

We do the same of course, but in the instance I am thinking of we did it
retrospectively, ( ie same day!) though the work was done for reasons of
improvement and to prevent self-sown trees destroying the coping of a
very huigh retaining wall above a railway cutting.  

Problem is now that I have an electioneering councillor stirring the
proverbial over it and describing it as "environmental vandalism done
without permmission" . I would, of course, like to shut him up by having
chapter and verse as a last resort.

There lies the problem ... whether the public perceive the Council to be
responsible! As a matter of course and to ensure consistency and
transparency, Mole Valley District Council always gives 6 weeks notice
for any works to trees in a CA. Why wouldn't we?

This is of course a presumption that trees in the Council's management
are 
actually in 'good' management. Whether that is a safe assumption or not
is a  
moot point.....
