We would normally hold the view that any supporting documents for a S
211 notice would be in the public domain. In fact, we scan them into our
planning interactive website. I would think that any copyright would
only be affected if said documents were to be used by another. Tricky
one when it comes to actually copying documents, even if they can just
print the document straight of a public website.
Mind you, I'm no Lawyer, so you might be better off paying no attention
to me!

Sorry if this is a bit obscure for a wet Friday morning in the office,
but ...
If someone sends in a document with a S.211 Notice, such as a tree
report from a consultant, does this become a public document?
If a member of the public wants to see it / have a copy, should we say
yes or does the person who submitted it (who presumably owns the
copyright) need to be consulted first?
Is there official guidance or regulation about this, or is it maybe down
to each Authorities internal procedures?
Questions, questions (and I should probably know the answer, or at least
know where to look!), but I suspect mischievous intent behind the
request for the report...
