Dear Iain

I agree with many of your comments. However, most of our tree work
applications and section211 notices come from tree surgeons who are not
AA approved and who have got there work by forming a good local client
base, over a long period of time, through their quality of work and
value for money. In my experience and opinion (it is only that and not
necessarily fact), it is rarely the smaller companies that are AA
approved but they may indeed get more work in specific areas because the
bigger approved companies can sometimes charge considerably more
(presumably due to overheads) and perhaps give less of a personal
service. I always suggest to the public to go on a recommendation. It
would be actually recommending a firm that could land us in court and
not suggesting that an industry body, who actively promote good working
practices in terms of arboriculture and business, be used to find an
arborist.

I am happy in myself that I am a competent and experienced
Arboriculturist but it is not my place or the place of a local authority
to make that sort of judgement about others by producing a 'Council
list'. The AA has proven competent at this activity over the years and
there may be room for others.  

It's a difficult one though eh!

Have you ever Asked them Why ????

the sole promotion of any one group of business, simply because they
have a 
badge issued by a none mandatory self proposed regulatory body & then
the 
consequntial exclusion of others, because they choose not to   ' is
illegal

& I cant believe Public funded bodies think they cant do it.
 these businesses may not be comparipal in ability,  companys have
various 
chargeable rates & to exclude competant operators, unfairly weighs on
the 
bill payer.   Best Value !!!!!!
Therefore  it is not the place of Authoritys to make that decision.
 Its like telling them that fortnum & Mason or Harrods can deliver there

weekly food, without giving them the numbers for Asda or Sainsburys just

because,  etc !!

You have already expressed your personal professional approval of some
local 
arborists working professionally  within your area. obviously because
they 
meet your expectations.

For the authority to proactively encourage private individuals to seek a

professional service is commendable,  there is however, no requirement
to 
belong to 'any' such organisations.
In fact any person wishing to obtain direction from the authority,
should be 
given the details of any person(S)  who has expressed an interest in the

inclusion, on such a data base of companys / persons as operated by the 
authority.

The person should then ascertain the qualification / insurance and 
competance in so far as they can carryout any tree work to Bs 3998 or
5837 
as applicable .
Bs3998 doesnt state a person must be qualified it simply gives a
standard to 
acheive,   where they have the skill / ability  to reach this standard &

conform to the relevant  hse legislation as applicable to the task Not
with 
standing  Aerial chainsaw use legislation, If Used
It is incumbent on any person employing a contractor to satisy
themselves of 
this.

Given your current policy

If the wheel came of on a job  or where colusion between companys was
proven 
in a tight labour market.

how would the authority stand should a formal complaint be lodged  !!
where the authority operated an approved  strictly limited list of
companys
 A chat with legal services perhaps  ?

It is entirely up to the individual contractors as to what lists they
wish to be included on.
