Just an opinion and not the official party line. I just feel there could
potentially and hypothetically be problems where for instance a 'local
authority approved' arborist doesn't keep up the public liability
payments and drops a tree on something breakable (head, house, car etc).
The LA would need to actively and constantly update the list to ensure
that this never happens. Is this always viable?

When drawing up the lists, this was one of the things that we
contemplated. In point of fact it has been 'robustly' discussed for
quite some time. In theory I suppose that if the above scenario occurred
then there would be some liability attached to the Council having
'reccomended' the contractor. If the lists were drastically out of date
or badly administered then a court may take that into account (we review
the details on a yearly basis) However in practice I am of the opinion
that the responsibility for the incident would rest almost entirely with
the contractor as would the fact that they hadn't kept their insurance
up to date. I suppose theres always the possibility that someone may
take up such a case against the local authority but I think it would
have to be on the scale of criminal negligence or similar. I would be
interested to hear if there have been any cases brought against local
authorities in this situation.
