I would have thought that as long as the position of the tree is plotted
correctly, the TPO is valid. However, probably a good idea to make a new
one or a variation order, if only to keep things up to date.

My reasoning here would be that TPOs are often made for an address which
is subsequently developed and becomes a different address. These should
be updated but are still valid orders I would think (I hope!!!!).

Hello all,

Thanks for the contributions to the yew/Laetiporus issue - always a
learning experience and one I'm glad of even if I look a bit dim at
times!

Now for another one - what's the legal position of a TPO served to the
wrong address? I think, but haven't confirmed yet, that a boundary tree
is much less of a boundary tree than has been supposed for the last five
years, and therefore the TPO may have been attributed to the ownership of
a neighbour, who for reasons of her own has kept this fact to herself.

And if this turns out to be correct, do I revoke and designate a new
one, or can I vary the old one?

Alan
