I'm pretty sure that if the proposed works are not associated with the
remedial notice then they would still need consent under the TPO whether
common law rights apply or not.

Another problem we have here;
PINS regard a line of conifer trees as a High Hedge. Remedial works have
been accepted which overrides the requirement of an application for tree
works as they were/are growing and protected within an Area TPO. Does
this give the neighbour rights to cut back any overhanging branches seen
as a High Hedge?
