You're right! Within the clauses of the Misc. Prov. Act, it says, "The 
Council may", and, there would appear to be no actual requirement for a 
Council to act. However, I believe that a Council that failed to do so would 
most likely be negligent if an incident involving injury were to arise after 
they had been requested to act. And, there are fairly, a number of options 
available to Councils within the clauses of the Act ... They can give notice 
to a land owner, make a neighbour take on the land and deal with the tree, 
make the tree safe at minimum cost, recover the costs from the landowner or 
notifier, or do nothing if they feel the situation is not imminently 
dangerous.

With regards to the Miscellaneous Provisions Act and dangerous trees I 
believe it is up to each individual Local Authority on whether they take on 
these duties. Most Local Authorities do, but some don't. It has to be in the 
LA's Scheme of Delegation otherwise they don't have the powers. If the tree 
is within falling distance of the Highway it can be dealt with under the 
Highways Act 1980.
