What do think about clause 2 Chris? If the consultant is a
landowner or occupier of land (anywhere). I think that covers
just about anyone. I could be wrong ... I often am.

If the consultant owns a plot 100 miles away, it is unlikely to meet the
requirement of 23(2)(b)

"considers that the tree is in such a condition that it is likely to
cause damage to persons or property on the first-mentioned land; and"

I suspect that the recent thread on just how high a tree can grow would
have a bearing on how far away the consultant's house can be.
