If the consultant is acting for the landowner to survey their trees, and then
comes across the trees on adjoining land that are deemed dangerous, then why
not just report them to your client, who can then inform the LA? That would
save any argument, as the client is the adjoining landowner.
I think the bottom line is that if the tree is dangerous and could cause
damage
or injury as a result of failure (whether that be on to public or private
land), you have to do what is necessary to prevent that from occurring. If
that
means a 'scatter gun' approach to notifying numbers of people to determine
ownership/liability, then that may be the only option available to you.
