Ian's first duty was to the court as a EW, this is the clear message that
has come down, solicitors are meant to bend the opinions to their best
advantage, but a EWs message must be clear and unambiguous otherwise the
cross
examination can get very tricky which is what happened here and the Judge
made that
clear in his appraisal.

A salutary lesson I am afraid

It was indeed a salutary lesson, and I squirm in sympathy for Ian. Do we
have to accept that Lawyers are allowed to swerve and wriggle while Arbs get
tied up and then slagged off for not being as wriggly and swervy as the
Lawyers.

Can't say I disagree with the outcome, but it seems that Ian got the wrong
side of Judge Hughes somehow. I also note that Judge Hughes isn't exactly
infallible either, his description of the position of the crack as being 60
degrees out between 8 and 9 o'clock or 10 and 11 o'clock on the north not the

south side: er what?

Anyway it's made me sit down and think a bit....

Bill.
