Peter,
When the 1APP system was launched earlier this year there was a bit of a
problem with using it to submit applications for "County TPOs" - the problem
being you couldn't do it as it automatically goes to the District/Borough,
they then have to email it on to the County Council. Has this "problem" been
fixed yet? I have never received an application direct from the planning
portal so can only assume it hasn't - please advise.

The Town and Country Planning (Trees)(Amendment)(England) Regulations
2008 were laid before Parliament on 29 August 2008. They come into force on
1 October 2008. The full text can be found at

These new Regulations introduce -
* A new standard, mandatory application form for work to trees
protected by a tree preservation order (TPO). An application made in any
other manner cannot be accepted by the local planning authority.
* A requirement that information to support the reasons for the
proposed work must be provided with the application.
* A fast track appeals process. The days of written representations
will be replaced by the Planning Inspectorate, on appeal, considering the
representations and information supplied with the original application.
(This is similar to the process for dealing with appeals in respect of the
high hedges legislation under the Anti-social Behaviour Act 2003.)
The new form, with its companion guidance, will shortly be available
on our website and will replace the tree work form currently available on
the Planning Portal (part of 1APP). All Local Planning Authorities in
England will be advised formally of these changes. Our guidance in Tree
Preservation Orders - A Guide to the Law and Good Practice (The Blue Book)
will be updated on our website to reflect the introduction of these
Regulations.
There will be no change to the serving of new TPOs on adjacent
landowners at this time. This will be considered in conjunction with
the more fundamental proposals to produce a shorter TPO which are
being considered as part of the Planning Bill currently in the Lords
and which will be subject to consultation in due course. This will
lead to a major overhaul of The Blue Book.
