Blimey!!

Rock that boat or what! I wouldn't have the nerve to exempt them after a 
Councillor had requested the App went to Committee. Mind you I've only ever 
had one application go to committee and they allowed the tree to be felled 
against my recommendation to refuse the application. You never can tell with 
Cllrs.

If you believe the trees are at risk from imminent failure, exempt them from 
formal Planning control and allow him to fell them. Once the trees are down, 
the LPA would have to instigate prosecution proceedings against him if they 
felt that the TPO had been breached. The Legal Department will take expert 
advice from their arboriculturists, which will say that there is no case to 
answer.

This might upset a few people, but knowing your circumstances, it might not 
bother you too much.
