If an Order is unconfirmed, the Order cannot be enforced.  Therefore, an
application is technically not valid for works to any tree that is in
the unconfirmed Order.

Section 201 allows the TPO to take effect immediately for a period of 6
months only.  If the Order is not confirmed within this time, the
protection lapses until such times as the Order is either confirmed or a
new Order made to replace the original.

Depending on the tree, I would either get Legal to confirm the Order
ASAP (especially if you would refuse the felling) or make anew one ASAP.

I have an application to get works done on an unconfirmed to a fell one
tree and b 30% reduction on the other. I was told by a colleague that I
cannot allow any works to trees until the order is confirmed. Im working
my way through Mynors but cannot find anything about this. Is this
correct before I send a letter out? I was going to refuse the felling
anyway but would have allowed the reduction. I just want to make sure
which letter I should send.
