I fail to see where you find it reasonable to demand that a poor tree is replaced. I don't think you can do it with the CA/TPO regs and really the only way the planning process can require it is to make the proposal conditional on new planting. This might eventually attract TPO protection after the Planning Condition has lapsed/been forgotten.
