I quite often specify, no dig or low invasive, in order to help with
level problems and usually accept that topsoil will be removed to 10cm.

Exactly! I gather what's being said is that the topsoil will become
unstable and therefore the ccs will not be effective. They say they
consulted with with the manufacturer and confirmed this. I think it's
something that needs to be verified - as per Gareth's comments - can't
see what's wrong with asking for their own spec on the site.
