I'm not at all clear what might constitute " 'unreasonable behaviour'
which causes unnecessary costs". Would someone like to explain it to me?

There is now a right to claim for costs arising from any TPO appeal,
whether it is dealt with by way of a hearing or inquiry, or by the
written fast-track procedure. 
Section 322 of the Town and Country Planning Act 1990 came into full
force on 6 April 2009. This introduces a right for appellants and local
planning authorities to claim for costs on appeals. Circular 03/09 -
Costs Awards in Appeals and Other Planning Proceedings covers the
details in full.  
As a result, it has been necessary to revise the content of the Addendum
to Tree Preservation Orders - A Guide to the Law and Good Practice (the
Blue Book) to cover the issue of costs arising from TPO appeals. 
A new version of the Addendum has just been posted on our website at
www.communities.gov.uk/treesandhedges (with changes to text
highlighted).
