To answer the question you'd have to ask the SofS why. To be blunt the
ultimate answer to the question is 'thats just how it is' right or wrong as
the thing is. Maybe when the next update to TCPA is made or a full change to
the TCP (trees) regs this will be addressed.

I have no doubt that a place could be found for some TPO application
guidance within the LDF. The original question is still unanswered
though. Why the apparent contradiction in the blue book that seems to
encourage development plan policies for making TPOs but rejects them for
determining applications (which fall under the planning acts and should
therefore be subject to section 54A)?
