It doesn't say they can't pay regard to Policy, just that they don't have  
to. Perhaps they accept that sometimes prudent management might be to fell a 
 protected tree, which seems counter-intuitive but might be justified and 
might  be in conflict with the Policy.
 
I think there is a large assumption within BB that once a tree is  
protected, then everything must have been done properly and there is 
something  
special about the particular tree. Those of us with experience of remant 
trees,  
that is former members of a protected 'Group' but that are now solitary  
specimens might be less sanguine about this.
