True enough Glyn, but whatever the complexity and obscurity of the
legislation, a common sense approach should always prevail, and I think what
Chris and others have suggested as the explanation should do, here.
Barristers sometimes favour complexity, I believe.

Perhaps you're right.....perhaps not. The argument is there (and I'll
have to dig out the paper to confirm the detail) and was put by a
planning barrister (not me), and as far as I'm aware hasn't been tested.
All I'm saying is that maybe things are not quite as simple as your
definitive statement might imply. Planning rarely is.
