Bill,

I try to tell clients of the likelihood of planning success, at least in
relation to trees but usually they've already bought the site and the best I
can do is recommend they reduce impingement as much as possible. If
impingement on B or A category trees is inevitable then I might end up
suggesting removal and replacement with large specimens in a well prepared
rooting environment elsewhere that in the mid term would add up to more
crown cover. I stress this is going to be expensive and require maintenance
and supervision and not a very high probability of planning success. As an
Arboricultural consultant in a situation where the client is already
commited this is the best I can do. As you say its down to others to decide
whether the overall benefits of the development outweigh the loss of habitat
continuity and historical amenity value.

But no my comment regarding what's a site is not a wind up. I fairly
regularly tell people that their project is a non-starter; think CA, section

notice is going to provoke a TPO, good quality noticeable trees that would
get B  or A cat; it's not a site, "save your money."

I'm not saying I actually like the schemes that come across my desk, or
that despite them meeting policy that I think they're a good idea. Just that
the  TPO system could legitimately be used to thwart them and so forgetting
the  scheme is the best option. I also tell clients when I think the TPO
system might  be illegitimately used to scupper a project; thus they get a
warning that the scheme is likely to cost them a lot of money and a visit
from
PINS. AFAICT  tell an appeal is always gonna be a toss-up and not for me to
comment upon  anyway. That advice is for a Planning Consultant.
