Ultimately I suspect each case will be taken on merit and an insurance  
company will decide using their usual cost formula and loss adjusters  
opinion. 
 How that might change in the case of a civil or criminal case  arising 
from the incident is a different matter.
 
Knowing how insurance companies like to wriggle out of paying I imagine  
they may get touchy where a challenge is made in the courts.
