Ah ha, OK Gilbert, I understand now. I get a few odd scenarios each year
as well. I would hope, that there is no case to answer at this time and
probably the best way forward is to ask twenty questions of your
customer isn't it? and let them make their own decision. First question.
Is the hedge still there? ... Other questions including, is it an
offence to plant a leyland hedge? ... ... ... Second to last question.
Has an actual offence been committed? Last question. Could any
organisation pursue the complaint in the absence of an offence? Letter?
Could you actually predict the demise of the hedge??????? General advice
to your customer is probably, "give me a call when the hedge actually
dies."

Consider if you will a hedgerow between two parcels of agricultural
land, that is, one to which the Hedgerow Regs apply. The owner of one of
the two parcels plants Leylands 'inside' the line of the existing
hedgerow such that as the Leylands grow they overshadow and ultimatley
kill the original hedgerow. Is he culpable of destroying a hedgerow to
which the regulations apply without first submitting a Hedgerow Removal
Notice?
