RE: New TPO Regs For England

Subject: RE: New TPO Regs For England

Well m'lud my client has a right to trim the tree as it overhangs the flats
community garden of which he is part owner. They weren't served with a copy
of the TPO at the time it was made as required by virtue of the regulations.
I contend that the TPO is defective to the point of uselessness. And that's
before I start on common law right v statutory protection.

So, immediately
adjoining neighbours should be included really ... remember, they have a
'right' to cut back overhang!

I thought one of the points of the review was to remove all that faff with
sending everybody in a block of flats a copy of the order...... So I'd be
inclined to wing it, after all "ignorance is no defence." And f'crying out
loud, we're trying to cut down our use of everything, which includes sheets
of paper.

Bill.
