Well m'lud my client has a right to trim the tree as it overhangs the flats 
community garden of which he is part owner. They weren't served with a copy 
of 
the TPO at the time it was made as required by virtue of the regulations. I 
contend that the TPO is defective to the point of uselessness. And that's 
before 
I start on common law right v statutory protection.

I think that would come down to an argument about on precisely whom it was 
necessary to regard as having an interest. I mean even if you're exercising a 
right of abatement you're still gonna ask the owner's permission aren'tcha? 
As flat-dwellers frequently turn out to be under-equipped for tree surgery, 
they ought to turn to the contractor who ought to be more familiar with the 
rights and wrongs. A contractor up before the beak would have no defence of 
that nature anyway.... This is always assuming that it's not exempt of course.

I am dead against Town Halls wasting money and natural resources and sending 
hundreds of people copies of paperwork that's going to go straight in the 
recycling just doesn't make any sense in this day and age. Tell that to me 
learn'd friend and get him on the moral low ground!
