However, if someone cuts the brake pipes on your car and your unaware
of it and you subsequently crash as a result of the scrotes actions,
who would be held liable?

Luke's take on this, is the advice I give. I also caveat that they
should take professional advice on the root pruning. Hopefully this
advice prevents the general hacking of tree roots by lay people.

As I see that Moray, the Scrote is responsible for criminal damage (no way 
was your brake pipe a nuisance to him) but if you were driving it and knocked 
someone's wall down, you'd be responsible. You would have the defence that 
you didn't know the scrote had been scroteful, but if you were driving....

I routinely give the same advice as Luke (on moral grounds, not to mention 
the "you don't wanna ridiculous Court case grounds") but as luck would have 
it I'm dealing with just such a case now and I can see the 
Lemmon/Webb/nuisance palaver emerging.
