Yeah, I know. So, should we defer to the old one still? The CA bit is
easy but the 99 regs bits cause problems. Maybe we should continue to
play safe and as said before, it's no skin off my nose to have one
process in place ... Simple site Notice, easy and polite anyway ...
Transparent. In my view the Parks Section or LPA tree managers should
always put notices up on Council sites to explain what they're doing
anyway, it's not hard is it?

The problem is ... What will the new Blue Book say given that the 99
regs are being overridden???? The other thing is that there are so few
TPOs on Council trees that we forget there are differences and, in the
light of this Council not consulting on apps anymore, it does confuse
the matter. I should know better really ... It's Friday and I'm tired!

Actually, I think I got confused. We don't need to apply to ourselves
for CAs but we should do for TPOs and in that respect we are supposed to
publicise so it is simpler to have one process.

Blue Book:

Local Authority Applications

6.76 LPAs are no longer required to apply to the Secretary of State if
they want consent to cut down or carry out work on trees or woodlands
protected by TPOs. They are now responsible for determining their own
applications (ie applications made by any department of the Council as a
whole and not just their planning department).

Publicising Applications
6.77 Before determining their own application the LPA must publicise it
by displaying a site notice on or near the land in question for at least
21 days. The purpose of the notice is to inform local people about the
proposal and give them an opportunity to submit their comments on it.
The site notice must:

(1) give details about the nature of the application (identifying the
trees, the work proposed and the LPA's reasons for the application),
including an address where a copy can be inspected,

(2) give an address to which any comments about the application should
be sent,

(3) give a date by which representations have to be made. At least 21
days from the date of display of the site notice must be given.

Conservation Area Exemptions

9.3 Exemptions from the requirement to give a section 211 notice are set
out in the 1999 Regulations. You do not have to give the LPA six weeks'
notice:

(3) for work carried out by, or on behalf of, the LPA (ie the Council as
a whole and not just its planning department),

Your words made me wonder. Our authority presently does not erect site
notices for normal applications/S211 notices. But we (LA parks
department) do submit applications/notifications along with everyone
else. We don't erect any signage either. Is there a further requirement
for consultation that we are not fulfilling?

You don't have to serve Notice on yourself but you must put a site
notice up in order to consult so, the easiest thing to do is deal with a
formal Notice which, you can of course not respond to unless
representations are received. I that case you must consider them.

I understand the LPA does not need to give notice to itself because it
is assumed to be a prudent manager. Of course if your tree team does
poor work then you'd want to discuss and remedy!

I have read that the LPA as a whole is exempt from having to give notice
to cut down trees in conservation areas. Is this correct as we (Planning
dept.) receive notice from the parks dept. to cut down trees in
conservation areas?
